The copyright Designs and Patents Act assign the copyright of the images to Ari' Place photographer Arianna Slusarek

Display

The client(s) hereby allow(s) Ari's Place to display any photograph taken under this contract and to generally promote the business in advertising,

Creative License, Coverage, and Reproduction

Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the client requirements.

Special requests are not binding instruction, although every effort is made to comply with the client's wishes. The Photographer/s will do their best to honor the requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location, or group arrangements due to changes in weather an the availability and willingness of subjects.

For a booking involving a church ceremony or at certain venues, the photographer's movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the photographer's choice and the photographer cannot accept responsibility for any obstructed view should this be the case.

Due to a variety of lighting conditions and the limitations of digital sensors, some colors may alter throughout a set of photographs.

Although al equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.

Payment

A non-refundable booking fee of $200 will confirm your booking, as well as full acceptance of the terms and conditions as published on the photographer's website. The booking fee will be deducted from the cost of the clients's chosen package when calculating the final balance due.

Payment in full of the remaining balance will be due two weeks before the sessions day. Additional goods ordered must be paid for in full at the time and day of ordering. Titles to all goods remains with the photographer until paid for in full by the client(s)

Force Majeure

In the event of cancellation by the photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid.

The photographer will endeavor to put the client(s) in touch with another photographer in the event they are unable to attend on the session date due to any causes beyond their reasonable control e.g sudden illness, injury, victim of crime, flooding, traffic conditions, vehicle breaks down, etc.

Digital Negative Files

All digital negatives (computer files) remain the property of Arianna Slusarek. All digital wedding packages include a copy of the cited digital negatives to the client(s) for their own non-commercial use

Should the digital negative sales be lost, damaged or destroyed for the reasons beyond control, the photographers liability shall be limited to a full refund of any deposits and fees paid, but shall not include a refund for any goods already received.

On The Day

The photographer will be the sole professional at the venues specified. The photographer does however positively encourage family, friends, and other guests to take photographs throughout the day.

For Weddings, the photographer will not take photos during the wedding breakfast and will use that time to take a break. The photographer will stay to photograph throughout the time desired by the client(s) up to 10pm. Any photography following thus time will be at the discretion of the photographer or if expressly feed in writing beforehand.

Personal Accident

Any directions issued to clients, their guests or employees during the photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

Cancellation Fees

If the client(s) should have to cancel a booking the following cancelation fees will become due immediately upon said cancellation:

Cancellation from the booking date and more than two weeks to go until the session date, the booking fee of $200 is due.

Cancellation with less than two weeks to go until the session date, the full price for the complete photographic coverage booked will be due. The client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation.

Delivery

The photographer will endeavor to deliver digital negative files as quickly as possible. However this could take 6-8 weeks during busy periods.

Wedding Contract

Below is the Wedding Contract. A signed copy must be on file at least 4 months before the wedding date.

Ari's Place will have coverage of up to 5-10 hours of the wedding day as discussed with clients. A consultation appointment will be included before booking the session. The photographer will do their best to accommodate as best as possible. It is understood that there may not be anything the photographer can do in some situations including upset guests, venue lighting, and building layout. Payment must be paid in a for that is accepted by Ari's Place. This includes cash, or check. Failure to provide payment in one of the listed forms will result in no session being booked. In addition, payment must be paid in two payments. Half of the invoice total at the time of booking as a non-refundable deposit, and the other half a month before the wedding. If this is not possible the photographer will try their best to work out a different schedule for payment if possible. If payment is not able to be received the event will be canceled. If no notice is given of a cancellation, full payment will result in full payment from client(s).

The photographer will not be responsible for any events that result in inability to show up. This includes, but is not limited to weather, car troubles, bodily injury, car accident, and sickness. The photographer is not be liable for any equipment malfunction that results in photos not being able to be taken. If the following occurs, a refund of 75% will be issued back to the client(s). If the client(s) provide wrong information, and/or fail to provide payment in full or in time will result in the event being cancelled and a 50% refund issued. You must cancel 3 weeks prior to the scheduled event. Cancellation notice after the 3 week mark the opportunity for a refund will not be offered.

The copyright Designs and Patents Act assign the copyright of the images to Ari's Place photographer, Arianna Slusarek.

No alterations, printing, or social media posts shall be made with the images unless a release contract is signed, and payment (if needed) is paid.

PERMISSION TO PRINT

Ari's Place grants permission to to make an unlimited number of prints of the images provided for personal(not commercial) use.

The images provided to you are licensed to you for personal purposes only, including but not limited to: printing, copying, emailing, & web publishing. This license does not include use that results in financial gain, including not limited to: advertising, stock photography, print sale profits, or resale of any nature financial or not. You may not under any circumstances alter, edit, or change images.
